Webvatize Design Studio Terms and AgreementIntroductionYou are hiring us as an independent contractor, for the purpose of designing a website to be published on a hosting and domain account on an Internet Service Provider (ISP). DevelopmentDuring the process of creating your web site, you can view the work in progress on a site owned by us or on your own, which would be hidden from the public until launch. This would allow you to give us feedback during the designing stages and we expect that you will promptly provide us with comments or instructions regarding any changes or corrections. PaymentAn initial non-refundable 50% deposit, of the expected project cost (A non-refundable deposit if we have started your project and in the event of the project being cancelled by the Client.) Payment duesDelinquent bills will be charge if payment is not received on/or before the extended grace period. If bills remain outstanding four days after the given grace period, Webvatize reserves the right to remove web pages from viewing on the Internet until final payment is made, any further dispute will be litigated. RefundsIn the event that the project's specifications change beyond our level of expertise, whereby the said project cannot be completed by us, then you will be refunded a portion of the deposit equivalent to the time already expended. CopyrightThe finished web design site will be owned by Webvatize until receipt of final payment, at which time full and complete ownership will be transferred to the client. (Please note: we have no control over the legal rights to photos, graphics, source code, work-up files, and computer programs that are owned by others.) Website MaintenanceThis agreement includes minor website maintenance over a one (1) month period from the starting date. Minor changes are defined as updating links, changes to sentences or paragraphs, but does not include replacing a large amount of text with new text that will alter the page design layouts or any major page and design reconstructions, adding new pages, website features, navigational structure changes, or correcting and repairing any attempted updates by clients which may have caused problems with the website after it was completed. Maintenance will, in most cases, be attended to within 48 hours of acknowledging the request for changes. Except in cases where a separate Maintenance package / agreement exists, regular maintenance will be charged at the current website design rate. Errors & LiabilitiesWe will use all due care and diligence to ensure your website is free from errors, and will correct any errors made by us at the earliest opportunity. We will not accept any responsibility for losses or damage arising from any errors on your website once it has been transferred to the host and made publicly available on the Internet. DisclaimerWebvatize cannot guarantee that your web pages will rank highly with search engines or directories. We assure you that we will do our best to conscientiously add the elements that will help make your website optimal. We cannot warrant that the functions contained in the web design project will be uninterrupted or error-free from any outside entity. |
